The case, which was transferred from Justice Adenike Coker of the Ikeja Division, involves Evans and his co-defendant, Joseph Ikenna Emeka.

At the resumed proceedings, the prosecution counsel, A. O. Azeez, appeared for the Lagos State Government, while Charity O. represented Chief Emefo Etudo on behalf of Evans, and Nelson Onyejiakor appeared for Emeka.

Azeez informed the court that the matter had been transferred and urged that the defendants be re-arraigned, noting that any pending plea bargain applications previously filed before Justice Coker would not affect the process.

The defendants were subsequently re-arraigned on an amended five-count charge bordering on murder, attempted murder, conspiracy to commit felony to wit: kidnapping, and attempted murder.

The prosecutor told the court that Evans and Emeka, committed the offences on or about August 27, 2013.

He said that the incident took place at about 10:00 p.m., along Third Avenue, Festac Town, Lagos.

Azeez said Evans and Emeka allegedly killed one Peter Nweke.

They were also accused of murdering one Chijioke Ngozi at the same location and time.

The offences, according to the prosecution, contravened Section 221 of the Criminal Law of Lagos State, 2011.

Evans and Emeka both pleaded not guilty.

Evans was being tried on five separate criminal trials involving allegations of kidnapping and murder, but he had already been convicted in two of them.

He is currently facing three separate criminal trials.

Justice Ogala adjourned the case to November 19, 2025, for hearing and the issuance of witness summons.
