DSS files criminal charges against Sowore, X, Meta over anti-Tinubu post

The Department of States Services (DSS) has filed a five-count charge against Omoyele Sowore over allegations of defaming President Bola Tinubu.

X Corp, the social media platform formerly called Twitter; and Meta (Facebook) Incorporation; were also joined as defendants.

Sowore, publisher of Sahara Reporters and former presidential candidate, had on August 25 described Tinubu as a “criminal” while reacting to the president’s comments on corruption during a recent trip to Brazil.

The DSS had earlier written to X, demanding the urgent deactivation of Sowore’s verified account.

Also, in a letter dated September 7, and signed by Uwem Davies on behalf of Adeola Ajayi, the director-general of the DSS, the secret police asked Sowore to retract his post on X and tender a public apology within one week.

The service ordered Sowore to retract the statement with the same prominence on X, publish apologies in at least two national newspapers and two television stations, and submit a formal representation to its headquarters in Abuja or via email.

The secret police has now filed a criminal suit before a federal high court in Abuja.

The charge sheet, marked FHC/ABJ/CR/484/2025, was filed on Tuesday.

Count one reads: “That you, Omoyele Sowore, adult, male on or about the 25th day of August, 2025, within the jurisdiction of this Honourable Court, did use your official X Handle page, @Yele Sowore, to send out a message/ tweet as: ‘THIS CRIMINAL @ OFFICIAL PBAT ACTUALLY WENT TO BRAZIL TO STATE THAT THERE IS NO MORE CORRUPTION UNDER HIS REGIME IN NIGERIA. WHAT AUDACITY TO LIE SHAMELESSLY!’, which you know the said message to be false but posted it for the purpose of causing a breakdown of law and order in the country, especially among individuals who hold divergent views on the personality of the President and Commander-in-Chief of the Armed Forces of the Federal Republic of Nigeria, Bola Ahmed Tinubu (GCFR) and thereby committed an offence contrary to Section 24 (1) (b) of the Cybercrimes (Prohibition, Prevention, etc) Amendment Act, 2024.”

Charge Two: “That you, Omoyele Sowore, adult male on or about the 26th day of August, 2025, within the jurisdiction of this Honourable Court, did use your official Facebook page, Omoyele Sowore, to send out a message/ post as : ‘THIS CRIMINAL @ OFFICIAL PBAT ACTUALLY WENT TO BRAZIL TO STATE THAT THERE IS NO MORE CORRUPTION UNDER HIS REGIME IN NIGERIA. WHAT AUDACITY TO LIE SHAMELESSLY!’, which you know the said message/post to be false but posted it for the purpose of causing a breakdown of law and order in the country, especially among individuals who hold divergent views on the personality of the President and Commander- in- Chief of the Armed Forces of the Federal Republic of Nigeria, Bola Ahmed Tinubu (GCFR) and thereby committed an offence contrary to Section 24 (1) (b) of the Cybercrimes (Prohibition, Prevention, etc) Amendment Act, 2024.”

Count three: “That you, Omoyele Sowore, adult, male on or about the 25th day of August, 2025, within the jurisdiction of this Honourable Court, using the instrumentality of X, via your official X account @Yele Sowore, did knowingly published defamatory material on your online platform viz: ‘THIS CRIMINAL @ OFFICIAL PBAT ACTUALLY WENT TO BRAZIL TO STATE THAT THERE IS NO MORE CORRUPTION UNDER HIS REGIME IN NIGERIA. WHAT AUDACITY TO LIE SHAMELESSLY!’, against the personality and reputation of the President and Commander-in-Chief of the Armed Forces of the Federal Republic of Nigeria, Bola Ahmed Tinubu (GCFR) and thereby committed an offence contrary to Section 375 of the Criminal Code Act.”

Count four: “That you, Omoyele Sowore, adult, male on or about the 26th day of August, 2025, within the jurisdiction of this Honourable Court, using the instrumentality of Facebook, via your official Facebook account Omoyele Sowore, did knowingly published defamatory material on your online platform viz: ‘THIS CRIMINAL @ OFFICIAL PBAT ACTUALLY WENT TO BRAZIL TO STATE THAT THERE IS NO MORE CORRUPTION UNDER HIS REGIME IN NIGERIA. WHAT AUDACITY TO LIE SHAMELESSLY!’, against the personality and reputation of the President and Commander-in-Chief of the Armed Forces of the Federal Republic of Nigeria, Bola Ahmed Tinubu (GCFR) and thereby committed an offence contrary to Section 375 of the Criminal Code Act.

Count five: “That you, Omoyele Sowore, adult, male on or about the 26th day of August, 2025, within the jurisdiction of this Honourable Court, with intent to cause public fear and disturbance, published false information on your official X and Facebook account @Yele Sowore, respectively, against the personality and reputation of the President and Commander- in- Chief of the Armed Forces of the Federal Republic of Nigeria, Bola Ahmed Tinubu (GCFR) and thereby committed an offence contrary to Section 59 of the Criminal Code Act and punishable under the same Act.”

The charges were brought on behalf of the DSS and the Federal Government by M.B. Abubakar, Director of Public Prosecutions at the Federal Ministry of Justice, alongside four other counsel to the DSS –M.E. Ernest, U.B. Bulla, Dr. C.S. Eze, and E.G. Orubor.

Confirming the development in a Facebook post on Tuesday , Sowore wrote, “The State Security Service, alias @OfficialDSSNG today filed a 5-count charge at the Federal High Court in Abuja against ‘X’ (formerly Twitter Facebook, and myself. They claimed that because I called Asiwaju Bola Ahmed Tinubu a criminal, I have somehow committed a set of ‘novel’ offences they invented and spread across five counts.

“It’s hard to believe there’s anyone sensible left in these offices that should be making Nigeria work. Regardless, I will be present whenever this case is assigned for trial. #RevolutionNow.”

The human rights activist and African Action Congress candidate in the 2023 election had vowed not to delete the controversial tweet, despite a request from the DSS to X demanding its removal.

Restating his stance, Sowore wrote, “This morning, X (formerly Twitter) officially contacted me about the despicable threat letter they received from the lawless DSS over my Tweet on Tinubu. One option I will NOT be taking is deleting that Tweet. Thank you, @X.”
